Registration procedure

Every person is entitled to a pension. To do this, you must contact the territorial body of the Pension Fund of Russia. Registration can be carried out not only personally in the FIU, but also in a multifunctional center.

Since the Federal Law "On State Pension Provision in the Russian Federation" contains rules governing the issues of pension provision for military personnel receiving a pension in accordance with the Law on Pension Provision for Military Personnel, the pensions established for such persons are considered as provided for by the Federal Law "On State Pension Provision". In accordance with the Law on the provision of pensions for military personnel, invalidity pensions may also be established for military personnel if the disability occurred during the period of their service or no later than three months after their dismissal from service, or if the disability occurred later than this period, but due to injury, concussion, injury or disease received during the period of service. A breadwinner's pension is granted to military families if the breadwinner died (died) during the service or no later than three months from the date of dismissal from service or later, but due to the above reasons.

Unlike the service pension for military personnel, the service pension for federal civil servants is additional, since it can only be awarded if the federal civil servant has the right to an old-age or disability pension. In this regard, the conditions for the appointment and size of this pension should be studied most carefully.

Article 9 of the Federal Law "On State Pension Provision in the Russian Federation" defines the conditions for granting a disability pension to two categories of citizens - participants in the Great Patriotic War and citizens awarded the sign "Inhabitant of besieged Leningrad", from among the disabled of groups I, II and III.

The cause of disability in this case does not matter (with the exception of cases when a participant in the Great Patriotic War or a citizen awarded the badge "Inhabitant of besieged Leningrad" commits unlawful acts or deliberately damages his health, in which case they may be assigned a social pension).

The Federal Law “On State Pension Provision in the Russian Federation” (Article 10) provides for the establishment of old-age pensions for persons affected by radiation and man-made disasters, but for disability and for the loss of a breadwinner. At the same time, certain norms of this article are of a reference nature. Disability pension under the state pension provision is assigned to disabled people as a result of the disaster at the Chernobyl nuclear power plant. In this case, the causal relationship of disability with the disaster at the Chernobyl nuclear power plant matters. Its size is 250% of the social pension. At the same time, for disabled people of group I, the amount of the pension is determined based on the increased amount of the social pension (subclause 2.1, clause 1, article 18 of the Federal Law "On State Pension Provision in the Russian Federation"). As for survivor's pensions, it is important to note here that this type of pension is provided to family members of not all categories of citizens affected by the Chernobyl disaster, but only three of them. Thus, the right to state pension provision is granted to families:

  • - citizens who received or suffered radiation sickness and other diseases associated with radiation exposure as a result of the Chernobyl disaster or work to eliminate its consequences;
  • - invalids due to the Chernobyl disaster;
  • - participants in the liquidation of the consequences of the disaster at the Chernobyl nuclear power plant in 1986-1990. in the exclusion zone.

When considering issues of state pension provision, due attention should be paid to the institution social pensions. This type of pension payments is a state guarantee of material support for these citizens in the event of socially significant circumstances (advanced age, disability, loss of a breadwinner).

Social pensions are established for disabled citizens who are not entitled to an insurance pension, and therefore, regardless of the performance of labor and (or) other socially useful activities, as well as the payment of legally established payments for the purpose of mandatory pension insurance (pension provision).

The following five categories of citizens permanently residing in Russia are entitled to a social pension:

  • - disabled people of I, II, III groups, including disabled since childhood;
  • - disabled children;
  • - children under the age of 18, as well as older than this age, full-time students, but not longer than until they reach the age of 23, who have lost one or both parents, and children of a deceased single mother;
  • - citizens from among the indigenous peoples of the North who have reached the age of 55 and 50 years (men and women, respectively), permanently residing in the areas of residence of the indigenous peoples of the North on the day the pension is awarded (this is an exceptional case in the pension legislation of Russia, when nationality is the basis for the difference in the conditions of pension provision citizen);
  • - citizens who have reached the age of 65 and 60 years.
